Terms of Service

1. Acceptance of Terms

By accessing or using Kynode ("Service"), operated by Nodemetrics, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

Kynode provides Korean business verification APIs, including real-time verification, batch processing, and related features as described on kynode.dev.

3. Account Registration and Security

To use the Service, you must:

• Provide accurate and complete registration information
• Be at least 18 years old or the age of majority in your jurisdiction
• Maintain the security and confidentiality of your account credentials
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized access

4. API Usage and Restrictions

You agree to:

• Use the API only for lawful purposes
• Respect rate limits and quotas for your subscription tier
• Not abuse, overload, or attempt to bypass the Service
• Not resell API access without written authorization
• Not reverse engineer, decompile, or disassemble the Service

5. Pricing and Payment

Subscription fees are charged monthly or annually based on your selected plan. All payments are processed securely through Stripe. Fees are non-refundable except as specified in our refund policy. If you exceed your plan limits, overage charges will apply as stated on the pricing page.

6. Refund Policy

We offer a 7-day money-back guarantee for first-time paid subscribers. To request a refund, contact hello@kynode.dev within 7 days of your initial payment. Annual plans may be refunded on a prorated basis within 30 days. No refunds are provided for partial months or for accounts terminated due to Terms violations.

7. Service Availability and SLA

We target the following uptime levels: 99% for Pro tier, 99.9% for Premium tier, and 99.99% for Enterprise tier. However, we do not guarantee 100% uptime and are not liable for service interruptions caused by maintenance, third-party failures, or circumstances beyond our control.

8. Intellectual Property Rights

The Service, including all content, features, and functionality, is owned by Nodemetrics and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. Prohibited Activities

You may not:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Transmit malware, viruses, or harmful code
• Scrape, spider, or crawl the Service
• Violate any applicable laws or regulations

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NODEMETRICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Nodemetrics and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Account Termination

You may cancel your account at any time through your Dashboard. Cancellation takes effect at the end of your current billing period. We may terminate or suspend your account immediately for violations of these Terms, with or without notice. Upon termination, your data will be retained for 30 days before permanent deletion.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the Gimhae District Court or Busan District Court.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
